I-751申请解除条件绿卡
申请前提
持婚姻移民签证入境时，结婚不满2年，将获得2年有效的条件绿卡，持K非移民签证入境，转身份时结婚仍不满2年的，也将获得条件绿卡。
在条件绿卡的批准日（以条件绿卡上标明的有效期为准）满2周年的前90天内需申请I－751解除条件绿卡，获得10年绿卡。
如无意中错过申请期限，需要跟移民中心书面说明理由。如实属无心之失或有客观原因无法如期申请（如等待离婚判决中），一般能获得豁免。

I－751需要夫妻联合联合签名申请，以下情况可以申请豁免联合申请：
o 诚意结婚，但随后美籍配偶去世。 （必须附上配偶死亡证书）
o 诚意结婚，但婚姻后来因离婚而终止。（必须收到离婚证书才可递交申请）
o 诚意结婚，现仍未离婚，但受到美籍配偶极度的虐待。（必须附上有关被虐证据，如果警方证明，医生诊断书，社工报告等）

如果子女获得条件绿卡的时间与父母获得条件绿卡的时间相差在90天之内，可以将合资格的子女包括在同一申请中，如超过90天子女将需要单独申请。

审理
共同申请的I-751一般无需面谈，移民局只会随机抽查2％，转到地区移民办公室面谈。
申请豁免的一般都会转到地区办公室进行面谈。
案件转到地区办公室后的进度一般无法预计，但可以参考当地处理AOS面谈的进度。
I-751的面谈与AOS面谈的注意事项基本相同。

通过后
如果免面谈获得通过，收到通知书后，带上2张正面护照照片，通知书，护照，驾照等预约上门办理制作新绿卡。
新绿卡将在1-6个月内（一般4－8周）寄到府上。

问题二十九：我第一位先生是个美国公民。我们在中国相识，结婚。但因为性格不合，在不到两年时间裹，我们就分居了。我拿到了我的第一张临时绿卡，之后我遇到了我现在的丈夫，我与前夫办理了离婚。我与现在的丈夫生活很美满，并育一子。我现在的丈夫也是美国公民，他帮我申请了I-485 和I-130，我愿意放弃以前的两年的临时绿卡，移民官通知我们去面试，但结果却是要进一步审理我的案子。我真不知还要等多久? 还有我应该怎么办? 还是只能无限期等下去?

解答: 对于你这个问题，我在问题24中有一些论述。如果你是K-1入境的，你可以读一下对那个问题的解答 。

如果你是非K-1入境的，你可以同第二个美国公民结婚申请"二合一"，最终拿到绿卡。但是前提是你第一个申请必须有了结果方可申请。在等待中是不可以申请的。

在拿到"有条件绿卡"后，要在Window Period申请I-751来把条件拿掉。在Window之前就离婚了，离婚判决下来后就要立即申请I-751，I-751最早可以在决定办离婚时就可以申请。（斑竹注：非常不专业。移民局最近的备忘录规定，离婚后单独提出申请的必须等拿到离婚证书才可以提出申请，早一天都不成。）这时因为只有你一个人签字。你申请变成了是要求豁免(Waiver)的申请。如果批准了，你可提前拿到永久绿卡，而不受Window Period的限制。但最晚不能晚于Window Period 的最后一天提出申请。这些要求在第一次面试时拿"有条件绿卡"时，移民官必须向你说明，并让你在一个文件上签字，保证移民局已经告诉了你要做I-751的事。如果你根本就没有申请，那你就是可逐境的了(Removable)。因为你的"有条件绿卡"，在Window 过后就作废了。

很有可能你和你第二个先生在你Window以前或Window后申请了I-130/I-485，移民局官误收了这个申请，而且进行了面试。在面试中发现你曾被给予了一个有条件的绿卡，没有任何I-751在你的档案中。移民局并不关注每一个有条件的绿卡的到期日，提前警告他们该申请I-751了，或者Window Period 过了，仍不见I-751而开始逐境过程。你就处在这个奇怪的情形里，面试官也不知道该怎么办，交到上司去处理，那么什么时候得出结果是没有任何期限的。

按照INA Section 216 (C) (2) (A)，未能在Windwo Period申请I-751或未能出席面试，移民局将终止有条件绿卡身份。没有任何条款可以豁免没有按时申请。(斑竹注：以下正如偶所说的)但移民局可以接受一个晚了的申请，一旦他们接受了这个申请，就是算"按时申请"案对待。Flores-Salgado v.后Caplinger, 872 F. Supp. 1521 (E.D. La, 1995)，换句话说，移民局可以攒这个空子接受你的I-751申请，然后拒绝I-751，然后考虑第二个丈夫的I-130 申请。但由于第二个I-130/I-485已经申请了，移民局很可能由于技术原因要Reject I-130/I-485，要求你们重新申I-130/I-485。因为他们的申请日期必须在I-751拒绝之后。

没有任何理由可以免去I-751的申请的，所以读者一定要注意I-751一定要申请的，共同或单独的申请。在拿到"有条件绿卡"之后离婚可不一定就拿不到永久绿卡。即使I-751拒绝了，如果已经同第二个公民配偶结婚，当然可以申请I-130/I-485，但必须在I-751的书面决定决定之后，在这一程序中，我遇到两个截然不同的结果，在面试I-751时，移民官说让我的客户回去等待书面决定。客户同时收到两个通知。一个是拒绝I-751的通知，另一个是开始逐境的通知。也就是移民局不想给她一个间隙从而使第二个公民配偶申请I-130/I-485。而另一个客户而收到拒绝通知。当天下午就将第二个I-130/I-485报了上去了，后来也没有接到逐境通知。我的感觉在你的案子中，如果移民局认为你第二个婚姻是真实的，而且第一个也是真实的，也就是说，如果你按时申请I-751，你的I-751也会获批准的，移民局也许会帮助解决未报 I-751 申请而造成的困境。故我的想法是，立即交I-751，附上所有支持文件和申请费。并附上我所述案子以使移民局官员知道这案子的存在，看看移民局怎么处理。

如果两个申请都是拒绝，移民局会开始逐境过程，然后你们可以在逐境过程重新报上I-130/I-485的申请。
